Rock the New Food Pyramid provides tools to analyze packaged food products, including NOVA processing-level classifications, ingredient analysis, and identification of additives. The Service uses barcode scanning, text search, and image-based product recognition ("Gator Vision") to provide information about food products.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement. The Service is intended for general consumer use and is not designed for users in regions where its use would be illegal.

3. Accounts

You may use most features without an account. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to notify us immediately at support@rockthenewfoodpyramid.com of any unauthorized access.

4. Acceptable Use

You agree NOT to:

Use the Service for any unlawful purpose
Submit false, misleading, or malicious product corrections
Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
Scrape, harvest, or systematically extract data from the Service without our written permission
Reverse engineer, decompile, or disassemble any portion of the Service
Use automated tools (bots, scrapers, spiders) without our written consent
Upload images that contain personal information of others, copyrighted content you do not own, or any unlawful or offensive material
Interfere with or disrupt the Service or the servers and networks connected to the Service
Misrepresent your identity or affiliation

5. User-Submitted Content

When you submit content to the Service (including correction reports, comments, and Gator Vision photos), you grant Dr. Seuzz LLC a worldwide, non-exclusive, royalty-free license to use, store, process, modify, and display that content solely for the purpose of operating and improving the Service. You represent that you have the right to submit such content and that it does not violate any third-party rights.

We are not obligated to review user-submitted content but reserve the right to remove, edit, or reject any submission at our discretion.

6. NO MEDICAL ADVICE — IMPORTANT

The Service does not provide medical advice, diagnosis, or treatment. All information provided by the Service — including but not limited to NOVA scores, ingredient analyses, processing classifications, and dietary categorizations — is for general educational and informational purposes only.

The Service is not a substitute for professional medical advice, evaluation, or treatment.

7. AI-Generated Content Disclaimer

Portions of the Service use artificial intelligence (AI) and machine learning systems to identify products, classify ingredients, and assign NOVA scores. AI systems can and do make mistakes. Specifically:

NOVA scores may be AI-estimated when official data is unavailable. These estimates can be incorrect.
Ingredient extraction from product photos may misread or miss ingredients.
Product identification may incorrectly match similar-looking products.

You acknowledge that AI-generated information is provided "as is" without any guarantee of accuracy. You are responsible for verifying critical information against the actual product packaging.

8. Third-Party Data and Services

The Service uses data from third parties including Open Food Facts (under the Open Database License), the Kroger Product API, Google Programmable Search, and Groq AI. We do not control these third parties and are not responsible for the accuracy, completeness, or availability of their data. Use of third-party data is subject to the respective providers' terms.

9. Intellectual Property

The Service, including its design, code, branding, and original content, is owned by Dr. Seuzz LLC and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission. Product names, brand logos, and packaging shown in the Service are the property of their respective owners and are used for identification purposes only.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT INFORMATION PROVIDED IS ACCURATE, COMPLETE, OR CURRENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DR. SEUZZ LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify, defend, and hold harmless Dr. Seuzz LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any rights of another party, or (d) content you submit to the Service.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time. Provisions intended to survive termination (including Sections 6, 7, 10, 11, 12, 14, and 15) will continue to apply.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Pasco County, Florida, and you consent to the personal jurisdiction of those courts.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notice or email (if you have an account). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force.
